8. Use of AI-Generated Stories
- MyMemori.es provides AI-based tools to generate narratives, videos, and other outputs from User Content
- These generated outputs are informational and creative in nature and are not guaranteed to be factually accurate
- You acknowledge and agree that MyMemori.es is not liable for any reliance placed on AI-generated outputs
9. Disclaimers & Limitations of Liability
9.1 No Warranty
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We expressly disclaim all warranties, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy
- That the Services will be uninterrupted, secure, or error-free
- That any data or content will be accurate, complete, or preserved
- That defects will be corrected or that third-party services will function properly
9.2 Complete Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYMEMORI.ES, ITS OWNERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

- Acts or omissions of third parties, including hosting providers, AI services, authentication providers, or other vendors
- Any direct, indirect, incidental, special, consequential, or punitive damages

- Personal injury or emotional distress resulting from your use of the Services
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR €100 (ONE HUNDRED EUROS), WHICHEVER IS LESS.

12.2 Class Action Waiver
YOU AND MYMEMORI.ES AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CLASS ARBITRATION, OR ANY OTHER REPRESENTATIVE PROCEEDING. You waive any right to participate in a class action lawsuit or class-wide arbitration.
12.3 Jury Trial Waiver
YOU AND MYMEMORI.ES HEREBY WAIVE ANY RIGHT TO A JURY TRIAL.
12.4 Time Limitation
Any claim or cause of action must be filed within one (1) year after the claim arose, or it will be permanently barred.
13. Governing Law & Jurisdiction
- These Terms are governed by and construed under the laws of The Netherlands, without regard to its conflict of law provisions
- Subject to the arbitration provisions above, any disputes that cannot be arbitrated shall be resolved exclusively before the competent courts of Amsterdam, The Netherlands
- You consent to the personal jurisdiction of such courts and waive any objection based on inconvenient forum
14. Changes to Terms
- We may update these Terms from time to time. The updated version will be effective upon posting
- Continued use of the Services constitutes acceptance of the revised Terms
15. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
16. Entire Agreement
These Terms constitute the entire agreement between you and MyMemori.es regarding the Services and supersede any prior agreements.
